the activity in the U.S. continues to rise. Many states are considering legislation to curb the foreclosure crisis. Nothing of course you can use it at this point, but the States seem to believe that increased regulation of mortgage companies, at least the situation. Mortgages Licensing is one of the most hotly debated issues in the states. Consumer groups felt that there should be increased licensing, education and commitment for the mortgage companies and their employees. Many people think that too many requirements, the difficulties in of a borrower to find the right loan for the right price as the mortgage companies need to spend more money to these requirements. Let's take a look at recent legislation in relation to mortgage licensing.
Washington mortgage licensing
Washington has the requirements for mortgage lenders. Many now have a license under the Consumer Loan License. What activities can a licensed mortgage broker in the context of the Mortgage Broker Practices Act (MBPA) without the licensing requirements of the Consumer Loan Act (CLA)? As a licensed mortgage broker you may act in these capacities:
Broker - the support of the debtor, or if you are in the situation, the borrower on a residential mortgage loan. Loans close in the name of the lender.
Table Fund - "" table-funding "a solution in which a mortgage loan is determined by a simultaneously before the loan funds and an assignment of the loan to the person, the promotion of the Fund. The mortgage broker originates the loan and closes the loan in its own name with funds, at the same time by a lender, the loan is closed. WAC 208-660-006.
Non-delegated correspondent - you close loans in your name with funds provided by a lender on a credit line. The lender is the underwriting criteria of the borrower, and makes the final decision underwriting.
Masachussetts Loan Originator Licensing
WHO is committed to a mortgage loan ORIGINATOR license?
Any natural person who: (a) is employed or in conjunction with one (1) and not more than 1 mortgage lender or mortgage broker licensee by the department, and (b) negotiates, solicits, offers, provides or accepts residential mortgage loan applications on property located in Massachusetts, or assists consumers in completing these applications.
Sole Owner license as a mortgage broker or mortgage lenders by the department, as well as the owners, officers and directors or entities with a license as a lender or mortgage broker, are required for a license as a mortgage loan originator in Massachusetts if it the above definition.
WHEN CAN AN INDIVIDUAL mortgage for a LOAN ORIGINATOR license?
LOAN WHO originators working for a licensed mortgage lender or mortgage BROKER before 30 November 2007:
Applications must be submitted to Massachusetts through NMLS before 28 May 2008. The condition for the candidates have a residential mortgage lending value of course not for every person who worked for a licensed mortgage lender or mortgage broker before 30 November 2007. Individuals, employers have been since 30 November are also not necessary for a course to become licensed. Please note that any person who meets these data from employment and who is not a license application with the Department of Banking before 28 May is a residential mortgage lending value of course is licensed.
LOAN WHO began originators for a mortgage lender or mortgage LICENSED BROKER AFTER the 29th November 2007:
Applications must be submitted to Massachusetts through NMLS before 1 July 2008. Prior to the licensed, all applicants must have a Residential Mortgage Lending Course was developed by the Department of Banking. However, the applicant may submit their application to Massachusetts through NMLS filings before the completion of a course. People currently classified as loan originators may continue to operate after 30 June only if they have submitted a mortgage loan originator license application through NMLS Massachusetts. From 1 July, each of which does not have a license application pending with the Department for banks can not continue lending in Massachusetts. Any person making an application before 1 July will be up to 31 August 2008, a residential mortgage lending value of course. If such an applicant is not a training course before 1 September 2008, his / her mortgage loan originator license application will be terminated.

Oklahoma amendment to the conditions for the formation of mortgage brokers and mortgage originators
Effective 1st November 2008 new applicants for a mortgage broker license in Oklahoma must have completed 20 hours approved training in the three years immediately preceding the date of application, and the new applicant for a mortgage loan originator license is required to have 16 hours approved training in the three years immediately preceding the date of application.
Tennessee Mortgage amends licensing requirements
Effective January 2009, applicants for a license as a mortgage lender, mortgage loan brokers, mortgage loan provides, or mortgage loan originator is required to establish a pedagogical training. Criminal background checks will also apply to mortgage lenders, mortgage loan brokers, mortgage loan provides, or mortgage loan originator for registered candidates and want to continue to mortgage loan originator registration.
Minnesota Additions loan definition of residential loans
On 1 August 2008, the definition of "Residential mortgage loan" under the Residential Mortgage Originator and servicer Licensing Act (the "Act") will be extended to commercial loans secured by 1-4 family residential real estate. The bill also expands the definition of the term "residential" to include non-residential property, and extends certain record-retention requirements from 26 to 60 months.
Colorado adopted a state of emergency management education and training compulsory for mortgage brokers
With effect from 1 January 2009 all mortgage broker, the applicant shall submit the 40 hours of licensing education and examination in two parts before applying for a mortgage broker license.
All mortgage brokers who are currently a Colorado mortgage broker license must be 40 hours of education and licensing, the two-part licensing examination on 1 January 2009.
Illinois Anti-Predatory Lending Database Registration for mortgage brokers and Loan Officers
On 15 May, Illinois registration of mortgage brokers and loan, with the Anti-Predatory Lending Database. The Anti-Predatory Lending Database Program, pursuant to Public Act 95-0691, will be on 1 July 2008. To mortgage any property against Cook County, a Certificate of Compliance or Certificate of Exemption must be made to the mortgage. Property outside of Cook County is not subject to the Act. A mortgage broker or loan, the originator of a loan application will be required to make certain information in the database. The database will first determine whether the property is exempt. If it is not exempt from tax, the database will then decide whether it will be necessary for the borrower (s) to receive counseling. If counseling is not required, the loan can close. If advice is required, the borrower (s) will be notified and receive a list of all participating counseling agencies. The law aims to reduce predatory lending practices by assisting borrowers to understand the terms and conditions of the loan for which he or she has. The law does not prohibit any type of loan.
Connecticut Eliminates Secondary Lenders and Brokers Act
At 1 July 2008, new legislation essentially no longer with the secondary mortgage lenders, brokers and originators Act by consolidating all regulation of mortgage lenders and brokers under one law. The bond for lenders and brokers is also the licensee and the mortgage license application procedures and requirements will be modified accordingly.
Iowa Code Chapters changes approved by the Banking Department
With effect from 1 January 2009 new legislation will be the educational and examination requirements for persons who are subject to registration under the Mortgage Banks and Brokers Act. At 1 July 2008 the necessary guarantee amounts and increase the annual license or registration expiration dates will change from 30 June to 31 December for mortgage banker and broker licensees.
